LIMITED HYBRID BATTERY WARRANTY, TERMS OF SERVICE, AND LIMITATION OF LIABILITY

This Limited Hybrid Battery Warranty (“Limited Warranty”) applies to hybrid battery products and installation services provided by HEV Rescue (“HEV Rescue,” “we,” “our,” or “us”).

By purchasing a hybrid battery and/or installation services from HEV Rescue, the customer acknowledges that they have read, understood, and agree to the terms and conditions contained in this Limited Warranty.

WARRANTY COVERAGE

4-Year Unlimited Mileage Limited Warranty

Covers defects in materials, workmanship, and installation for four (4) years from the original installation date with no mileage limitation.

4-Year / 48,000-Mile Limited Warranty

Covers defects in materials, workmanship, and installation for four (4) years or 48,000 miles, whichever occurs first.

The applicable warranty is determined solely by the warranty listed on the original invoice.

All warranty periods begin on the original installation date and apply only to the original purchaser and the original vehicle identified on the invoice.

If HEV Rescue determines that the installed hybrid battery has failed due to a defect covered by this Limited Warranty, HEV Rescue will, at its sole discretion, repair or replace the covered hybrid battery at no charge for covered parts and labor.

Any repair or replacement performed under this Limited Warranty does not restart, extend, or renew the original warranty period.

PRODUCT ACKNOWLEDGEMENT

The customer acknowledges that the hybrid battery installed may be manufactured by an independent third-party manufacturer or assembled using OEM components, depending upon the product purchased.

HEV Rescue does not manufacture hybrid batteries or hybrid battery components. Our services are limited to the inspection, testing, installation, assembly (where applicable), and warranty support of the hybrid battery installed in the customer’s vehicle.

HEV Rescue selects products based upon supplier reputation, quality, available testing information, reliability, and professional experience. No representation is made that any hybrid battery will exceed the warranty expressly provided herein.

Hybrid batteries naturally age and degrade over time. HEV Rescue does not guarantee any specific battery lifespan, battery capacity, vehicle fuel economy, or future vehicle performance beyond the warranty expressly stated in this document.

MOBILE SERVICE

HEV Rescue provides mobile installation services where available.

The customer is responsible for ensuring the vehicle is located in a safe, legal, and reasonably accessible location.

If the vehicle cannot be safely serviced at its location, HEV Rescue may require the vehicle to be relocated before service is performed. Additional travel or service fees may apply if disclosed prior to service.

WARRANTY SERVICE REQUESTS

All warranty requests must be initiated by contacting HEV Rescue before any repairs are performed.

The customer may be required to provide:

HEV Rescue reserves the right to inspect and diagnose the vehicle before approving any warranty claim.

If the installed hybrid battery is found to be operating properly or the concern is unrelated to the installed hybrid battery, HEV Rescue may charge a diagnostic fee of up to $200.00.

WARRANTY SERVICE REQUIREMENTS

All warranty inspections, diagnostics, repairs, and hybrid battery replacements must be performed exclusively by HEV Rescue, unless prior written authorization is provided.

The customer agrees to notify HEV Rescue immediately upon experiencing a potential warranty concern and to provide HEV Rescue with a reasonable opportunity to inspect and diagnose the vehicle before any repairs are authorized.

Repairs, diagnostics, battery removal, modifications, or replacement performed by any other repair facility, dealership, technician, or individual without prior written authorization from HEV Rescue will void this Limited Warranty.

HEV Rescue is not responsible for work performed by third parties and will not reimburse the customer for repairs, labor, diagnostic charges, or parts purchased elsewhere without prior written approval.

PERMANENT DIAGNOSTIC TROUBLE CODES (PERMANENT DTCs)

Certain hybrid vehicles utilize Permanent Diagnostic Trouble Codes (Permanent DTCs).

Permanent DTCs cannot be manually erased by HEV Rescue using a scan tool or diagnostic equipment. These codes are retained and cleared only after the vehicle completes the vehicle manufacturer’s required drive cycles and self-diagnostic procedures.

Following hybrid battery replacement, a Permanent DTC may remain stored even though the original concern has been corrected.

The time, mileage, operating conditions, and drive cycles required for a Permanent DTC to clear are determined solely by the vehicle manufacturer.

HEV Rescue has no control over when Permanent DTCs are removed and cannot guarantee when they will clear.

The presence of a Permanent DTC alone does not indicate a defective hybrid battery or unsuccessful repair and is not considered a warrantable condition.

WARRANTY EXCLUSIONS

This Limited Warranty is void if any of the following occur:

Misuse, abuse, neglect, or improper operation of the vehicle.
Collision, accident, fire, flooding, environmental contamination, or exposure to hazardous chemicals.
Tampering, disassembly, modification, or unauthorized repair of the hybrid battery.
Removal, alteration, or damage to warranty labels, serial numbers, or tamper-evident seals.
Installation of the hybrid battery into any vehicle other than the original vehicle listed on the invoice.
Vehicle modifications that are not in accordance with the vehicle manufacturer's specifications.
Installation, diagnosis, repair, or battery removal performed by anyone other than HEV Rescue without prior written authorization.
Vehicle storage exceeding thirty (30) consecutive days without normal operation.
Salvage, rebuilt, flood, dismantled, or branded title vehicles unless approved in writing by HEV Rescue before installation.
Conditions beyond the reasonable control of HEV Rescue.

NON-COVERED CONDITIONS

This Limited Warranty does not cover failures caused by conditions unrelated to the installed hybrid battery, including but not limited to:

Engine failures
Poor engine performance
Fuel system failures
Inverter failures
Cooling system failures
Transmission failures
Charging system failures
Electrical wiring faults
Corrosion
Rodent damage
Water intrusion
Poor vehicle maintenance
Pre-existing vehicle defects

Diagnostic Trouble Codes (DTCs), warning lights, or customer concerns alone do not establish a warranty claim.

Warranty coverage applies only when HEV Rescue determines that the installed hybrid battery is the cause of the failure.

TOWING, TRANSPORTATION, AND INCIDENTAL EXPENSES

This Limited Warranty covers only the repair or replacement of the covered hybrid battery.

HEV Rescue does not provide towing services and does not reimburse for:

Towing
Roadside assistance
Rental vehicles
Ride-share or transportation expenses
Hotel or lodging expenses
Lost wages
Loss of vehicle use
Shipping expenses
Diagnostic charges from other repair facilities
Labor performed by third parties
Incidental, indirect, consequential, or special damages

The customer is responsible for making the vehicle reasonably available for inspection and warranty service at a location designated by HEV Rescue. If transportation of the vehicle is required, it shall be the sole responsibility of the customer unless otherwise agreed to in writing by HEV Rescue.

EXCLUSIVE REMEDY

The customer’s sole and exclusive remedy under this Limited Warranty shall be the repair or replacement of the covered hybrid battery, at the sole discretion of HEV Rescue.

HEV Rescue does not provide refunds, partial refunds, reimbursement for unauthorized repairs, or cash compensation unless expressly authorized in writing.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, HEV Rescue disclaims all warranties not expressly stated in this Limited Warranty, including any implied warranties of merchantability or fitness for a particular purpose.

HEV Rescue shall not be liable for incidental, indirect, consequential, special, exemplary, or punitive damages arising from the installation, use, or failure of the hybrid battery, including but not limited to vehicle downtime, towing expenses, transportation costs, rental vehicles, lost income, or loss of vehicle use.

TRANSFERABILITY

This Limited Warranty is non-transferable and applies only to the original purchaser and the original vehicle identified on the original invoice unless otherwise approved by HEV Rescue in writing or where required by applicable law.

Installation of the hybrid battery into any other vehicle automatically voids this Limited Warranty.

WARRANTY CLAIM PROCEDURE

To initiate a warranty claim, the customer must promptly contact HEV Rescue before authorizing any repairs.

HEV Rescue must be given a reasonable opportunity to inspect and diagnose the vehicle.

If unrelated repairs are required before a warranty determination can be made, those repairs shall be the sole responsibility of the customer.

CUSTOMER ACKNOWLEDGEMENT

Customer acknowledges and agrees that:

I have read and understand this Limited Warranty.
I understand the warranty applicable to my hybrid battery is identified on my original invoice.
I understand HEV Rescue does not manufacture hybrid batteries.
I understand all warranty work must be performed by HEV Rescue unless prior written authorization is provided.
I understand HEV Rescue does not provide or reimburse towing, transportation, rental vehicles, or third-party repair expenses.
I understand that Permanent Diagnostic Trouble Codes (Permanent DTCs) are controlled by the vehicle manufacturer and are not, by themselves, a warrantable condition.
I understand that HEV Rescue cannot guarantee fuel economy, battery lifespan, or future vehicle performance beyond the express terms of this Limited Warranty.
I understand that no employee, technician, salesperson, or representative is authorized to modify this Limited Warranty through verbal statements.
